City of North Miami authorized to pay $750,000 in eight equal annual installments of $93,750 to Edwidge Valmyr Gabriel, beginning one year after the bill's passage, plus an additional $4,185.50 for medical lien reimbursement.

Compensation is for the wrongful death of Stanley Valmyr, age 7, who drowned on March 30, 2007 at Thomas Sasso Pool during a city-operated Fun Day camp due to negligent lifeguard supervision.

Settlement resolves tort claim case number 08-22810(13) in the Eleventh Judicial Circuit Court; City of North Miami previously agreed to pay $200,000 under statutory liability limits.

Attorney's fees, lobbying fees, costs, and related expenses are capped at 25 percent of the award amount.

This appropriation represents sole compensation for all present and future claims arising from Stanley Valmyr's death.
