Entities that divert wastewater flows from facilities discharging through ocean outfalls must meet the 60-percent reuse requirement established in section 403.086(9)(c), Florida Statutes.

Reuse of diverted wastewater flows by the diverting entity counts toward meeting that entity's reuse obligations.

Diverted flow amounts are deducted annually from the receiving facility's actual wastewater flow calculations, and the receiving facility's reuse requirement is recalculated accordingly based on the reduced flow.

The Legislature finds that ocean outfall discharges waste valuable water resources and compromise coastal environments, declaring that stricter treatment and management requirements and elimination of ocean outfalls are in the public interest.

Effective date: July 1, 2010.
