Creates a public records exemption for reports filed by examining committee members in incapacity proceedings under Florida Statutes section 744.331.

Allows disclosure of the confidential reports only to: circuit judges, the alleged incapacitated person, their attorney, the public guardian, appointed guardians and their attorneys, appellate courts on appeal, and persons ordered by the court.

Cites public necessity to protect the privacy of alleged incapacitated persons and prevent harm from disclosure of their financial or medical information.

Subjects the exemption to the Open Government Sunset Review Act and requires legislative reenactment by October 2, 2015 to prevent automatic repeal.

Takes effect October 1, 2010, contingent on passage of HB 1431 or similar legislation in the same legislative session.
