Exempts individual records of children in the Voluntary Prekindergarten Education Program from public records requirements, including assessment data, health data, teacher observations, and personal identifying information.

Applies the exemption to records held by early learning coalitions, the Agency for Workforce Innovation, or Voluntary Prekindergarten Education Program providers, regardless of when records were created.

Permits parents to inspect, review, and obtain copies of their child's Voluntary Prekindergarten Education Program records.

Allows release of confidential records to federal auditors, researchers, accrediting organizations, emergency responders, the Auditor General, courts with subpoenas, and parties to interagency agreements implementing the program.

Removes the scheduled October 2, 2010 repeal date and sunset review requirement, making the exemption permanent.
