Reclassifies violations of unlawful operation of soundmaking devices in motor vehicles from nonmoving violations to moving violations, resulting in points assessed against the driver's license.

Establishes increased penalty structure for repeat violations within 12 months: $120 for a second violation and $180 for a third or subsequent violation of section 316.3045.

Maintains existing prohibitions on operating radios, tape players, or other soundmaking devices that are plainly audible at 25 feet or more from the vehicle, or louder than necessary in areas adjoining churches, schools, or hospitals.

Preserves exemptions for law enforcement vehicles, emergency vehicles, and motor vehicles used for business or political purposes in the normal course of conducting such business.

Takes effect July 1, 2010.
