Designates proprietary confidential business information held by agencies as confidential and exempt from public records disclosure, including business plans, internal audit reports, external audit reports for private companies, and trade secrets as defined in s. 688.002.

Requires agencies to notify the proprietor when someone requests records containing proprietary confidential business information, and the request is granted unless the proprietor verifies within a reasonable time that the information meets confidentiality criteria through written declaration.

Allows any person to petition a court for public release of confidential records if the court finds the information is not a trade secret, a compelling public interest exceeds the need for confidentiality, and release will not cause damage to the proprietor or others.

Provides that this exemption does not supersede other applicable public records exemptions existing before or created after July 1, 2010.

Repeals s. 815.045, F.S. relating to trade secret information, and sunsets the exemption on October 2, 2015, unless the Legislature reenacts it.
