Creates Florida Ban on Texting While Driving Law, prohibiting operation of motor vehicles while manually typing or sending/reading text messages on wireless communications devices.

Establishes exceptions for emergency personnel, reporting emergencies, receiving navigation or safety alerts, using navigation systems, and voice-based communication that does not require manual text entry.

Classifies first violation as noncriminal nonmoving traffic infraction; second or subsequent violation within 5 years classified as moving violation, with enforcement allowed only as secondary action during detention for other traffic violations.

Allows billing records and witness testimony as admissible evidence in proceedings to determine violations.

Amends driver license point system to assign 6 points for unlawful use of wireless communications device resulting in a crash, effective October 1, 2010.
