Extends immunity from civil damages to health care providers (including non-hospital employees) providing emergency care or medical consultation services for patients with emergency medical conditions, except in cases of reckless disregard for consequences affecting life or health.

Defines "reckless disregard" as conduct that a health care provider knew or should have known created an unreasonable risk of injury substantially greater than conduct constituting simple negligence.

Limits immunity to acts or omissions occurring prior to patient stabilization (or post-surgery stabilization if required) and related to the original medical emergency.

Requires emergency care facilities granted immunity to accept and treat all emergency patients within operational capacity regardless of ability to pay; noncompliance allows the department to initiate disciplinary action.

Contains severability clause and provides for retroactive application of the act, effective October 1, 2010.
