Prohibits erecting a building or structure on one's own land if any part encroaches beyond the legally recorded boundary onto adjoining property, unless an easement or agreement exists.

Requires the landowner with the encroaching structure to remove all or the portion of the building or structure that extends beyond the property boundary.

Grants the owner of the encroached-upon land a cause of action in court against the encroaching landowner.

Authorizes courts to award actual damages, costs, reasonable attorney's fees, and injunctive relief to the prevailing party in encroachment disputes.

Takes effect July 1, 2010.
