SB 1248 - HIV Testing of County Detention Inmates

• Department of Health shall designate 7 counties (2 with 1.2+ million population, 5 with fewer) to participate in mandatory HIV testing program for sentenced inmates upon release from county detention facilities

• County detention facilities in participating counties must test inmates at least 30 days before release unless inmate is already known HIV positive or tested within 120 days, with exceptions for emergency releases and transfers to state corrections

• Facilities must notify Department of Health and county health departments of HIV-positive inmates' release dates and provide transitional assistance including HIV transmission education and individualized discharge plans with medical referrals

• Amends s. 381.004 to eliminate informed consent requirement for HIV testing of inmates in county or municipal detention facilities before release

• Grants immunity from liability to state, agencies, subdivisions, and employees for negligent death or personal injury arising from compliance with the testing program
