All health care providers, including physicians licensed under Florida chapters 458 and 459, must offer HIV testing as a routine part of annual physical examinations, with testing performed by approved laboratories under chapter 483.

Health care providers must inform patients that HIV testing is planned, provide information about the test, explain available treatment options for positive results, and advise that negative results require continued routine testing.

Patients have the right to decline HIV testing, and any written objection signed by the patient must be placed in the patient's medical record.

"Health care provider" is defined as a state-licensed person who performs physical examinations and orders, performs, or administers HIV testing as part of their scope of practice.

The Department of Health must adopt rules to administer this section, with the act effective July 1, 2010.
