Designates emergency health care providers acting under statutory obligations (s. 395.1041 or s. 401.45) as agents of the state entitled to sovereign immunity protections in tort actions.

Requires emergency health care providers to indemnify the state for judgments, settlement costs, and liabilities up to the liability limits in subsection (5), capped at those statutory amounts.

Imposes penalties on licensed emergency health care providers who fail to indemnify the state within 30 days of notice, including emergency license suspension by the Department of Health and administrative fines up to $10,000 per violation.

For hospital facilities licensed under chapter 395, authorizes withholding of state funds until indemnification obligations are satisfied or a repayment agreement is reached.

Takes effect upon becoming law and applies to causes of action accruing on or after the effective date.
