Department of Community Affairs must adopt playground safety rules in consultation with Department of Education, conforming to the 2008 Handbook for Public Playground Safety from the U.S. Consumer Products Safety Commission.

Defines "playground" as an improved outdoor area designed for six or more children, including equipment, surfacing, fencing, and related elements, but excluding athletic fields and courts.

All playgrounds constructed after January 1, 2011, must comply with the adopted safety rules.

Public funds cannot be used for playground planning, development, or redevelopment after July 1, 2011, unless the project will conform to safety rules upon completion, with an exception for projects already appropriated before July 1, 2011, if compliance costs do not exceed 15 percent of original project cost.

Act takes effect July 1, 2010.
