Re-creates the Emergency Response Trust Fund within the Department of Military Affairs (FLAIR number 62-2-087), which was scheduled for termination on July 1, 2011 under constitutional mandate.

Repeals section 250.175(2)(b) of Florida Statutes to abrogate provisions relating to the trust fund's termination.

Legislature determined the trust fund continues to meet an important public purpose and existing public policy provides adequate parameters for its use.

Takes effect July 1, 2010, but requires a three-fifths vote of both houses of the Legislature to become law.
