Amends s. 1005.38, F.S. to reorganize exemptions for investigatory records held by the Commission for Independent Education related to disciplinary proceedings and probable cause determinations.

Requires recordings of all closed portions of probable cause panel meetings, with no off-the-record portions permitted, and requires the commission to maintain the recordings.

Makes recordings of closed meetings and the minutes and findings exempt from public records requirements for a period not to exceed 10 days after the panel determines probable cause.

Extends the sunset review date for the public records exemption from October 2, 2010 to October 2, 2015, subject to the Open Government Sunset Review Act.

Establishes a statement of public necessity finding that exempting closed meeting recordings and findings protects deliberations while ensuring public oversight through the temporary nature of the exemption.
