Defines four new terms related to county water and sewer systems: "system capacity charge" (charge for new connections), "contribution-in-aid-of-construction" (money or property received to offset utility infrastructure costs), "contributor" (person making such contributions), and "hydraulic share" (pro rata share of utility facility capabilities available to the contributor).

Requires system capacity charges to be based on the actual hydraulic share used by the contributor during the preceding 12-month period.

Mandates county commissions refund contributors the difference if the system capacity charge exceeds the actual hydraulic share used during the 12-month period.

Allows county commissions to require contributors to pay the difference if the system capacity charge is less than the actual hydraulic share used during the preceding 12-month period.

Effective date of July 1, 2010.
