Schools with at least 40 percent of students of Haitian descent shall administer the Florida Comprehensive Assessment Test during the 2009-2010 school year but students are exempt from any adverse impact scores may have on promotion, retention, or graduation.

State Board of Education must adopt guidelines by September 1, 2010, for determining which schools qualify for this exemption.

Commissioner of Education must determine qualifying schools based on the guidelines and certify findings to the Governor, President of the Senate, Speaker of the House of Representatives, State Board of Education, and qualifying schools by October 1, 2010.

Exemption recognizes the continuing, devastating, and far-reaching effects of the January 12, 2010, earthquake in Haiti.

Effective date is July 1, 2010.
