Job orders placed with regional workforce boards for H-2B visa workers must remain active for at least 30 calendar days on the state's job bank system.

Employers posting H-2B job advertisements must place them within 30 miles of the area of intended employment.

State-funded construction contracts must require contractors to give preference to Florida residents if they have substantially equal qualifications as nonresidents.

"Substantially equal qualifications" means qualifications where an employer cannot reasonably determine that one person's qualifications are better suited for the position than another's.

Bill takes effect July 1, 2010; does not apply to federal aid-funded work where federal law prescribes different labor preferences.
