SB 2586 Summary

• Revises adverse incident reporting requirements for licensed health facilities and managed care organizations to use National Quality Forum standards, electronic submission within 15 calendar days, and quarterly CEO certification of accuracy.

• Establishes new patient rights protections for home health agencies including participation in care planning, advance notification of changes, property respect, and grievance procedures without reprisal.

• Requires home health agencies to employ staff for at least one service directly, implement written training and competency testing for home health aides, and establish detailed contractual requirements for contracted personnel.

• Creates administrative and personnel duties standards for home health agency administrators, directors of nursing, therapists, nurses, and home health aides including supervisory visit requirements and care coordination responsibilities.

• Requires State Fire Marshal to study firesafety standards in assisted living facilities and report findings to Governor and Legislature by November 15, 2010, including legislative recommendations.
