Creates a public records exemption for petitions to determine incapacity filed with the court clerk, making them confidential and exempt from public records disclosure laws.

Exemption applies to all petitions to determine incapacity, including initial, amended, and supplementary petitions, to protect the privacy of alleged incapacitated persons.

Legislature finds that public disclosure of financial or medical information contained in incapacity petitions would cause undue harm to the alleged incapacitated person.

Exemption is subject to the Open Government Sunset Review Act and automatically repeals on October 1, 2015, unless the Legislature reenacts it.

Contingent effective date of October 1, 2010, requires passage of companion legislation (SB ____) or similar bill in the same legislative session.
