CS/CS/HB 39 Summary

• Defines "homologue" as a chemical compound differing by one or more alkyl functional groups on an alkyl side chain for purposes of drug scheduling.

• Adds four synthetic cannabinoids (CP 47,497 and dimethyloctyl homologue, HU-210, JWH-018, and JWH-073) to Schedule I controlled substances.

• Makes possession of 3 grams or less of the newly added synthetic cannabinoids a first-degree misdemeanor, excluding the powdered form of these substances.

• Reenacts provisions of sections 893.13, 893.135, and 921.0022 to incorporate references to the new Schedule I synthetic cannabinoids in penalty and sentencing guidelines.

• Effective date: July 1, 2011.
