HB 55 Summary

• Creates section 1009.215 of Florida Statutes to establish a nonresident tuition exemption for undocumented students at state universities and Florida College System institutions beginning with the fall 2011 term.

• Requires eligible undocumented students to have attended high school in Florida for 3 or more years (non-consecutive) and graduated from a Florida high school or obtained a high school equivalency diploma.

• Mandates that students must be registered or currently enrolled at a Florida state university or college system institution and file an affidavit stating they have applied or will apply to legalize their immigration status.

• Requires the Board of Governors of the State University System to adopt regulations and the State Board of Education to adopt rules for implementing the exemption.

• Takes effect July 1, 2011.
