CS/HB 105 Summary

• Amends Florida Statutes section 856.015 to increase criminal penalties for violations of the open house party statute, which prohibits allowing minors to possess or consume alcohol or drugs at a residence.

• Second or subsequent violations of the open house party statute constitute a misdemeanor of the first degree, increased from the standard second-degree misdemeanor for first-time violations.

• Violations that cause or contribute to serious bodily injury or death to a minor, or result in a minor causing serious bodily injury or death to another person through alcohol or drug consumption at an open house party, are misdemeanors of the first degree.

• Effective date is July 1, 2011.
