Removes discretionary language allowing law enforcement agencies to decline applications for administrative expunction of arrest records for those arrested contrary to law or by mistake.

Permits arrestees or parents/legal guardians of minors to apply directly to the Department of Law Enforcement for administrative expunction without requiring endorsement from the arresting agency head or state attorney.

Requires applications by arrestees or guardians to be supported by documentation from the department stating the arrest was contrary to law or by mistake, replacing previous requirement for agency or state attorney endorsement.

Limits letterhead and signature requirements to applications submitted by law enforcement agencies under subsection (2), removing these requirements for applications submitted by arrestees or guardians under subsection (3).

Takes effect July 1, 2011.
