Amends section 903.046, Florida Statutes to require courts to determine whether a defendant is subject to registration as a sexual offender under section 943.0435 or sexual predator under section 775.21 when considering bail release.

Prohibits defendants required to register as sexual offenders or sexual predators from being released on bail or surety bond until their first appearance, except for defendants whose only criminal charge is a misdemeanor traffic offense under chapter 316.

States the purpose of the bail hold is to ensure full participation of the prosecutor and protection of the public.

Takes effect July 1, 2011.
