HB 347 - Ashley Nicole Valdes Act

• Requires defendants arrested for leaving the scene of a crash involving death to be held in custody until brought before a court for bail consideration if they have prior convictions for violating traffic safety statutes (s. 316.027, 316.061, 316.191, 316.193) or felony violations of s. 322.34.

• Maintains first-degree felony classification for willfully leaving the scene of a crash involving death, with mandatory minimum 2-year imprisonment term if the violation occurred while driving under the influence.

• Updates the Criminal Punishment Code offense severity ranking chart to reflect amendments to s. 316.027(1)(b) regarding accident-involved death and failure to stop violations.

• Effective date: October 1, 2011.
