Arresting officers must immediately impound or immobilize any motor vehicle driven by a person arrested for driving without a valid license or while their license is canceled, suspended, or revoked under Florida Statutes sections 322.03 and 322.34.

Motor vehicles owned by persons currently charged with these offenses shall also be impounded or immobilized if the owner was previously charged with the same offense within the past 5 years.

Impounded vehicles may be released to the registered owner if they were not the driver at arrest, or upon payment of towing and storage fees with proof of valid driver's license, vehicle ownership, and required insurance after any court-imposed period.

Vehicles may alternatively be released upon payment of towing and storage fees if the owner provides proof of sale and the buyer presents proof of valid driver's license, ownership, and required insurance.

The statute does not apply to minors and takes effect July 1, 2011.
