Prohibits ownership, operation, or maintenance of a pharmacy within a 10-mile radius of a pain-management clinic (registered under s. 458.3265 or s. 459.0137) that the same person owns, operates, or controls.

Violation of the pharmacy location restriction is a first-degree misdemeanor.

Prohibits dispensing practitioners who own, operate, or are employed by pain-management clinics from dispensing controlled substances (Schedules II-V) prescribed for clinic patients at any location within a 10-mile radius of the clinic.

Violation of the dispensing practitioner restriction is a third-degree felony.

Exempts workers' compensation patients, insured patients paying copayments or deductibles, and complimentary medication packages from the dispensing restrictions.

Effective July 1, 2011.
