Prohibits selling, manufacturing, or possessing with intent to sell controlled substances within 1,000 feet of homeless shelters, defined as supervised facilities providing temporary housing for persons lacking fixed residence.

Creates first-degree felony for violations involving Schedule I or II controlled substances (such as cocaine, heroin) near homeless shelters, punishable under existing penalty provisions.

Creates second-degree felony for violations involving other controlled substances near homeless shelters, including cannabis and Schedule III-IV drugs.

Adds two new offenses to the Criminal Punishment Code offense severity ranking chart at Level 5: selling Schedule I/II drugs within 1,000 feet of homeless shelter (first-degree felony) and selling other controlled substances within 1,000 feet of homeless shelter (second-degree felony).

Effective date is July 1, 2011.
