Miami-Dade County bus operator failed to stop at a stop sign on February 12, 2009, colliding with pedestrian James D. Feurtado, III, causing serious neurological and orthopedic injuries including brain hemorrhage, skull fractures, and permanent hearing loss.

Miami-Dade County authorized to appropriate and pay $1.15 million to James D. Feurtado, III as compensation for injuries and damages sustained in the accident.

Total settlement agreement between Miami-Dade County and Feurtado is $1.25 million, with $100,000 already paid under Florida's sovereign immunity limits and $1.15 million conditioned on passage of this claim bill.

Attorney's fees, lobbying fees, costs, and similar expenses related to this claim cannot exceed 25 percent of the total amount awarded under the act.

The payment serves as sole compensation for all present and future claims arising from the incident.
