CS/HB 1039 Summary

• Adds six new hallucinogenic substances to Florida's Schedule I controlled substances list: 3,4-Methylenedioxymethcathinone, 3,4-Methylenedioxypyrovalerone (MDPV), Methylmethcathinone, Methoxymethcathinone, Fluoromethcathinone, and Methylethcathinone.

• Reenacts sections 893.13, 893.135, and 921.0022 of Florida Statutes to incorporate the amendments to the controlled substances schedule and maintain consistency in criminal penalties and sentencing provisions.

• Maintains existing felony penalties for possession, sale, manufacture, and delivery of Schedule I controlled substances, with sentences ranging from first-degree felonies for trafficking to third-degree felonies for simple possession depending on the substance and quantity.

• Preserves mandatory minimum sentences and fines for trafficking in controlled substances, including 3-year minimum for 1-7 grams of LSD and 15-year minimum for 7 grams or more.

• Takes effect July 1, 2011.
