Retail tire dealers must provide written disclosure of replacement tire age to purchasers before dismounting old tires or mounting new ones, with disclosure initialed and dated by purchaser.

Disclosure must include tire manufacturing week and year, remaining factory warranty length, and a warning statement that tires deteriorate with age and vehicle manufacturers recommend replacement after 6 years regardless of tread depth.

Dealers must retain original disclosures for at least 3 years and provide copies to purchasers; requirement does not apply to private sales of used tires or tires on used vehicles.

Violations constitute deceptive and unfair trade practices subject to civil penalties up to $250 per violation, with collected penalties deposited into the General Inspection Trust Fund of the Department of Agriculture and Consumer Services.

Effective date is July 1, 2011; Department of Agriculture and Consumer Services shall adopt rules to administer the disclosure requirements.
