HB 1219 - Safe and Hygienic Bedding Act

• Prohibits manufacturing or selling bedding made wholly or partly from secondhand materials unless sanitized, germicidally treated, or cleaned using department-approved methods, including heat-treating, boiling water washing, or other effective decontamination techniques.

• Requires all bedding containing secondhand materials to display a clear red label (minimum 2 inches by 4 inches) stating "SECONDHAND MATERIAL" with specific details on materials, amounts, sanitization methods, processing date, manufacturer/renovator name, address, and permit number.

• Establishes permitting requirement for bedding renovators, sanitizers, and sellers of renovated bedding, with annual renewals and fees not exceeding $500, and recognizes valid permits from other states upon compliance with Florida requirements.

• Authorizes the Department of Agriculture and Consumer Services to conduct random inspections and product tests, with authority to embargo, recall, destroy, or dispose of non-compliant bedding and to deny, suspend, or revoke permits or impose administrative penalties up to $500 per violation.

• Makes knowing sale of improperly sanitized or unlabeled secondhand bedding a second-degree misdemeanor; requires department adoption of rules for permit procedures, inspections, and administration.
