HB 1273 Summary

• Creates section 45.022, Florida Statutes, to restrict application of foreign law that does not grant the same fundamental liberties, rights, and privileges as the U.S. Constitution and Florida Constitution.

• Voids any court or arbitration ruling based on foreign law that denies parties equal constitutional rights and privileges.

• Voids contract provisions choosing foreign law or foreign venues if enforcement would violate a natural person's constitutional rights; strictly construes any waiver of constitutional rights in favor of preserving those rights.

• Requires Florida courts to deny forum non conveniens claims if granting them would violate or likely lead to violation of a natural person's constitutional rights in a foreign forum.

• Applies only to natural persons, not corporations, partnerships, or other business entities; takes effect upon becoming law.
