• Requires responsible public entities to adopt and publicly release guidelines for public-private partnerships before considering proposals, with mandatory elements including competitive opportunities, financial analysis, and oversight procedures.

• Exempts public-private partnership procurements from the Consultant's Competitive Negotiation Act, allowing selection based on factors beyond lowest bid such as reputation, design, and local hiring plans.

• Provides for interim agreements allowing private entities to conduct preliminary work (design, planning, environmental analysis) and comprehensive agreements governing full development and operation including bonds, insurance, user fees, and maintenance requirements.

• Establishes a 12-member Public-Private Partnership Advisory Commission to review implementation and provide annual recommendations to the Governor and Legislature beginning December 13, 2012, with an effective date of July 1, 2011.
