City of Miami authorized to appropriate $2,550,000 plus 6 percent annual interest to compensate Melvin and Alma Colindres for wrongful death of their son Kevin Colindres caused by negligence of Miami police officers.

Payment results from arbitration award of $2,750,000 to the Estate of Kevin Colindres; City of Miami's $200,000 statutory liability payment combined with this legislative appropriation fulfills the total judgment.

Kevin Colindres, a severely autistic and intellectually disabled individual, died on January 5, 2007, after police officers placed him prone on the ground with hobble restraints, applied pressure to his back for over 10 minutes, and failed to promptly notify fire rescue when he stopped breathing.

Attorney's fees, lobbying fees, costs, and similar expenses relating to the claim are limited to 25 percent of the total amount awarded under this act.

Combined City of Miami payment and this appropriation constitute sole compensation for all present and future claims arising from Kevin Colindres's death.
