CS/HB 1369 - Jim King Keep Florida Working Act

• Allows courts to expunge a criminal history record after a prior record has been sealed or expunged, subject to restrictions including no arrests in the prior 10 years and only one previous expunction/sealing.

• Permits individuals with expunged records to lawfully deny or fail to acknowledge arrests and dispositions on employment applications without committing perjury or false statement violations.

• Authorizes the Department of Law Enforcement to disclose contents of expunged records to the subject upon written, notarized request.

• Similarly allows sealing of criminal history records after prior sealing or expunction, with a 5-year no-arrest requirement and one previous sealing/expunction limitation.

• Requires clerk of court websites to include information about sealing and expunction procedures with links to related information on the Department of Law Enforcement website.
