Reenacts Florida Statute 163.31801(5) to establish that government bears the burden of proving by preponderance of evidence that an impact fee meets state legal requirements or statutory standards in any legal challenge to the fee.

Prohibits courts from using a deferential standard when reviewing government-imposed impact fees in litigation.

Declares that the legislation fulfills an important state interest.

Takes effect upon becoming law with retroactive operation to July 1, 2009; reverts to prospective application only if a court of last resort finds the retroactive application unconstitutional.
