Repeals section 45.061, Florida Statutes, relating to offers of settlement made before 1990.

Amends section 44.102 to toll the time period for responding to offers or demands for judgment under section 768.79 until mediation reaches an impasse or the mediator reports no agreement was reached.

Allows offers or demands for judgment to be made at any time after an impasse is declared or the mediator reports no agreement, with offers deemed rejected upon commencement of trial.

Removes references to section 45.061 from section 766.209 regarding medical malpractice arbitration and settlement procedures.

Takes effect July 1, 2011.
