Transfers administration of school food service and nutrition programs from the Department of Education to the Department of Agriculture and Consumer Services, including the Food and Nutrition Services Trust Fund and all associated personnel, records, and unexpended balances.

Creates section 570.98 authorizing the Department of Agriculture and Consumer Services to conduct, supervise, and administer all school food service and nutrition programs using federal, state, or other funds, and to act as agent or contractor with federal and state agencies.

Renumbers and amends existing school food service statutes (sections 1006.06, 1006.0606, and 1010.77) to reflect the transfer to the Department of Agriculture and Consumer Services, maintaining requirements for school breakfast programs, children's summer nutrition programs, and the trust fund.

Requires school districts to send updated copies of wellness and physical education policies to both the Department of Education and Department of Agriculture and Consumer Services, and requires nutrition information to be accessible on the Department of Agriculture and Consumer Services website.

Takes effect January 1, 2012, contingent upon approval by the United States Department of Agriculture of a waiver request to transfer administration of school food service programs, with the Department of Education required to submit the waiver request within 30 days and notify state leadership of the federal decision.
