SB 174 Summary

• Reenacts provisions of the "Community Renewal Act" (chapter 2009-96, Laws of Florida) relating to growth management, comprehensive planning, and land development regulation.

• Reestablishes definitions and requirements for "urban service areas" and "dense urban land areas," capital improvements elements, transportation concurrency exception areas, and comprehensive plan amendments.

• Exempts proposed developments in dense urban land areas and designated urban service areas from the development-of-regional-impact review process.

• Extends and renews certain permits issued by the Department of Environmental Protection or water management districts that expired between September 1, 2008, and January 1, 2012, for an additional 2-year period.

• Applies retroactively to June 1, 2009, to protect those who relied on the changes made by Senate Bill 360 in 2009 and cure any alleged constitutional violations; if retroactive application is found unconstitutional, the act applies prospectively from its effective date.
