Removes discretionary language from law enforcement agencies regarding applications for administrative expunction of arrest records for minors and adults arrested contrary to law or by mistake.

Allows arrestees or parents/legal guardians of minor arrestees to apply directly to the Department of Law Enforcement for administrative expunction without requiring endorsement from the arresting agency head or state attorney.

Requires applications for administrative expunction to include arrest date and time, arrestee name, OBTS number, and charged crime(s), plus documentation from the department stating the arrest was contrary to law or by mistake.

Limits the requirement that applications be submitted on agency letterhead and signed by the agency head to those applications submitted by law enforcement agencies only.

Effective July 1, 2011.
