Changes requirement for counties or municipalities enacting animal control or cruelty ordinances from discretionary ("may") to mandatory ("shall") imposition of a $15 surcharge on each civil penalty violation.

Allocates surcharge proceeds as follows: $1 retained by clerk of court, $5 used for animal control officer training costs, and remainder used to subsidize spaying and neutering of dogs and cats in animal control possession or voluntarily submitted by owners.

Prohibits charging animal owners more for spaying or neutering services than the actual sterilization cost minus the surcharge subsidy amount.

Allows animal control authorities to redirect excess training surcharge funds to the spay and neuter program if collected funds exceed the amount needed for officer training in a given locality.

Does not require counties or municipalities to enact animal control or cruelty ordinances; effective July 1, 2011.
