Prohibits selling, manufacturing, delivering, or possessing with intent to sell controlled substances within 1,000 feet of a homeless shelter, defined as a supervised publicly or privately operated shelter providing temporary living accommodations for persons lacking a fixed, regular, and adequate nighttime residence.

Establishes first-degree felony penalties for violations involving controlled substances listed in s. 893.03(1)(a), (1)(b), (1)(d), (2)(a), (2)(b), or (2)(c)4., and second-degree felony penalties for violations involving controlled substances listed in s. 893.03(1)(c), (2)(c)1. through (2)(c)9., (3), or (4).

Adds two new offense rankings to the Criminal Punishment Code: selling controlled substances within 1,000 feet of a homeless shelter is a first-degree felony for specified high-level drugs and a second-degree felony for other controlled substances.

Effective date is July 1, 2011.
