First violation of unlawful soundmaking device operation in motor vehicles remains a noncriminal traffic infraction and nonmoving violation.

Second or subsequent violations of unlawful soundmaking device operation become noncriminal traffic infractions classified as moving violations with points assessed against driver's license.

Second violation of soundmaking device statute within 12 months results in $120 penalty.

Third or subsequent violation of soundmaking device statute within 12 months results in $180 penalty.

Bill takes effect July 1, 2011.
