Amends the definition of "public utility" in Florida Statutes to exclude certain renewable energy producers from regulation as public utilities.

Exempts entities that produce and sell 5 megawatt-hours or less per hour of renewable energy (as defined in s. 366.91(2)) from the definition of public utility.

Renewable energy exemption applies only when energy is sold to users located on property adjacent to, contiguous with, or within 1/2 mile of the production facility.

Effective date is July 1, 2011.
