Requires that for offenses committed on or after October 1, 2011, an advisory sentence of death in capital felony cases must be made by unanimous jury recommendation instead of a majority recommendation.

Applies the unanimous jury requirement to both capital felonies under section 921.141 and capital drug trafficking felonies under section 921.142.

Removes the phrase "a majority of" from sentencing statutes, allowing courts to impose death sentences notwithstanding jury recommendations but requiring written findings of aggravating and mitigating circumstances.

Maintains the requirement that courts must enter written findings supporting a death sentence within 30 days or automatically impose life imprisonment without parole eligibility.

Takes effect October 1, 2011.
