Requires jail and detention facility staff to determine the citizenship status of persons charged with felonies, driving under the influence, or boating under the influence.

Mandates facility staff request verification from the U.S. Department of Homeland Security within 48 hours if a prisoner is a foreign national to confirm lawful presence in the United States.

Requires facilities to notify the Department of Homeland Security if verification shows the person is not lawfully present and to confirm whether a federal immigration detainer will be requested.

Creates a rebuttable presumption that a prisoner verified as a foreign national without lawful status is at risk of flight for purposes of bond determination.

Requires state and local agencies to adopt written procedures complying with federal immigration law to implement these verification requirements; effective July 1, 2011.
