All records relating to clients of regional autism centers who receive services or participate in activities, and records relating to the clients' families, are made confidential and exempt from public records requirements.

Regional autism centers may release confidential records to physicians, attorneys, or governmental entities with client authorization; in response to subpoenas or court orders; or to the State Board of Education and Board of Governors for treatment, records maintenance, and program evaluation purposes.

De-identified client records may be released to bona fide researchers who sign confidentiality agreements and to center directors for statistical and research purposes.

Personal identifying information of donors or prospective donors to regional autism centers who wish to remain anonymous is made confidential and exempt from public records requirements.

The exemptions are subject to the Open Government Sunset Review Act and shall be repealed on October 2, 2016, unless reenacted by the Legislature; effective July 1, 2011.
