Transfers administration of school food and nutrition programs from the Department of Education to the Department of Agriculture and Consumer Services, including the Food and Nutrition Services Trust Fund and all related personnel, property, and unexpended balances.

Requires the Department of Agriculture and Consumer Services to conduct, supervise, and administer all school food and nutrition programs using federal, state, or other funds, and to cooperate with the federal government and other agencies.

Creates the Healthy Schools for Healthy Lives Council within the Department of Agriculture and Consumer Services with 11 members appointed by the Commissioner of Agriculture to advise on nutritional standards, childhood obesity prevention, and nutrition education.

Requires school districts to send updated copies of wellness and physical education policies to both the Department of Education and Department of Agriculture and Consumer Services when changes are made.

Makes the act effective January 1, 2012, contingent upon the United States Department of Agriculture approving a waiver request to transfer administration of school food service and nutrition programs.
